Labour pushes for bill to stop payday loan ads ‘grooming’ children

Labour is trying to introduce a ban on TV ads for payday loans before the 9pm watershed, in an attempt to prevent children pestering their parents to apply for them.

The Opposition is to table amendments to the Consumer Rights Bill, which is now going through Parliament.

In a two-pronged attack, Labour peer Lord Mitchell will bring in a Private Member’s Bill in the House of Lords which would introduce such a ban.

Stella Creasy, Labour’s spokeswoman on consumer affairs, will seek to amend the Consumer Rights Bill when it reaches its report stage after Easter. “We want to tackle the aggressive marketing practices of such companies,” she said.

“With 2.5 million people already in a debt management plan, our proposals are an opportunity to reform this industry before millions more end up caught in their crosshairs.”

Mitchell said: “Daytime television is deluged with advertisements for payday loans, many of them including fluffy puppets, catchy jingles and smiley people.

“Children see these advertisements and, not surprisingly, when family money is tight, they pester their parents to take out these loans.”

He has won support from former Conservative Cabinet minister Lord Forsyth, who said there was a “case for looking at daytime advertising” for both payday loans and gambling.

Baroness Benjamin, a Liberal Democrat peer, condemned payday loan ads as “a form of grooming” and said the industry’s code should be tightened to protect children.

Lord Newby, a Government spokesman in the Lords, said: “Personally, I find those adverts distasteful, but that is not to say I necessarily want to ban them all.”

He said payday loan commercials accounted for 0.6 per cent of all TV ads seen by children aged four to 15 in 2012, and personal debt ads on children’s TV amounted to 0.2 per cent of the total ad spend during children’s programmes.

Newby said the Government would decide whether to support Mitchell’s Bill after a review of payday loan ads by the Broadcast Committee on Advertising Practice is completed in the next few months.

Creasy has led a successful campaign against payday loan firms, which persuaded chancellor George Osborne to impose a cap on their cost after initially resisting the idea.

Leveraged Loan Volume Slides To $7.1B As Hot Market Begins To Cool

U.S. leveraged loan issuance totaled $7.1 billion over the past week, a drop-off from the $16.7 billion recorded last week, according to S&P Capital IQ/LCD. The week’s activity brings 2013 leveraged loan volume to $62.2 billion, down from the $70.2 billion seen at this time last year (in 2013, of course, U.S. issuance hit a record $605 billion).

The market continues active, though appears to have cooled somewhat, with a number of investor-friendly price flexes (where terms on a proposed loan are shifted so that issuers have to pay a higher interest rate or fee, due to market demand), according to LCD’s Chris Donnelly. Until recently, in today’s hot market, issuer-friendly prices flexes were rare.

As for deals, offshore oil concern Seadrill Seadrill Partners undertook the week’s largest new-money issue, a $1.7 billion credit that would refinance existing debt and back general corporate purposes.

Private equity sponsors were relatively active. In what was probably the highest-profile LBO deal of the week, Apollo brought to market its $875 million credit backing the roughly $1.3 billion leveraged buyout of CEC Entertainment (aka Check E. Cheese). And Apollo today unveiled a $305 high yield bond offering to go along with the bank loan.

U.S. institutional investors continue to sit on a mountain of cash. Loan funds saw a net $229 million inflow this week, according to Lipper. While that’s the smallest inflow total since December 2012, it’s the 86th consecutive weekly net infow, totaling $63 billion. The last net withdrawal seen at U.S. loan funds was June 2012.

The resulting market demand continues to keep borrowing costs low, especially for better-quality concerns. Yields to double-B issuers, which seemingly have little room to the downside, slipped to 3.28% this week from 3.30% last week. Yields on single-B issuers actually crept higher during the week, to 5.03% from 4.80%, according to S&P Capital IQ/LCD.
